Terms of Service

These Terms of Service ("Terms") govern your use of the Cartd website and application (the "Service") operated by Cartd ("we", "us", "our"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, please do not use the Service.
1. The Service
Cartd is an AI-powered meal planning tool that generates personalised weekly meal plans, shopping lists, and (where available) automated grocery cart filling for Australian supermarkets. The Service is designed to assist with meal planning convenience and is not a substitute for professional dietary, nutritional, or medical advice.
2. Accounts
To use the Service, you must create an account using a valid email address or through a supported sign-in provider (e.g. Google). You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.
You must be at least 16 years of age to create an account. By creating an account, you represent that the information you provide is accurate and that you will keep it up to date.
We reserve the right to suspend or terminate your account if we reasonably believe you have violated these Terms, engaged in fraudulent activity, or used the Service in a way that could harm other users or the Service itself.
3. AI-Generated Content Disclaimer
Meal plans, recipes, ingredient lists, and nutritional information provided by Cartd are generated by artificial intelligence (Anthropic's Claude) and are not reviewed by a qualified dietitian, nutritionist, or medical professional.
While we make reasonable efforts to ensure the AI respects your stated dietary requirements and allergies, AI-generated content may contain errors, omissions, or inaccuracies. It is possible for the AI to suggest meals that include ingredients you have listed as allergies or dietary exclusions.
You are solely responsible for reviewing all meal plans, recipes, and ingredient lists before preparing or consuming any food. If you have severe allergies, medical dietary restrictions, or health conditions that require specific nutritional management, you should consult a qualified healthcare professional before relying on AI-generated meal plans.
Cartd does not guarantee the accuracy, completeness, or suitability of any AI-generated content for your specific needs. You use AI-generated content entirely at your own risk.
4. Subscriptions and Billing
Cartd offers free and paid subscription tiers. Paid subscriptions are billed on a recurring basis (monthly or annual) through Stripe.
Free trials: Paid plans may include a 14-day free trial. If you do not cancel before the trial period ends, your selected payment method will be automatically charged at the applicable subscription rate. You can cancel at any time during the trial without being charged.
Recurring charges: By subscribing to a paid plan, you authorise us to charge your payment method on a recurring basis at the start of each billing cycle until you cancel. Subscription fees are non-refundable except as required by Australian Consumer Law.
Cancellation: You may cancel your subscription at any time through the billing portal in Settings. Cancellation takes effect at the end of your current billing period. You will continue to have access to paid features until your subscription expires. We do not offer prorated refunds for partial billing periods.
Price changes: We may change subscription pricing with at least 30 days notice. Price changes will apply from your next billing cycle. If you do not agree with a price change, you may cancel your subscription before the new price takes effect.
Refunds: In accordance with Australian Consumer Law, you are entitled to a refund if the Service has a major failure or does not meet a consumer guarantee. For refund requests, contact support@cartd.com.au.
5. Acceptable Use
You agree not to:
Share your account credentials with others or allow others to access your account; use the Service for any unlawful purpose or in violation of any applicable law; attempt to reverse engineer, decompile, or otherwise extract the source code of the Service; use automated tools (bots, scrapers, etc.) to access the Service except as expressly permitted; deliberately attempt to circumvent rate limits or usage restrictions; resell, redistribute, or commercially exploit the Service or its content without our written permission; or use the Service in any way that could damage, disable, or impair its operation.
6. Intellectual Property
The Service, including its design, code, branding, and original content, is owned by Cartd and protected by applicable intellectual property laws. You may not copy, modify, or distribute any part of the Service without our written consent.
AI-generated meal plans and recipes created through your account are provided for your personal, non-commercial use. You may save, print, and share your meal plans for personal purposes.
7. Grocery Cart Automation
Where available, Cartd offers the ability to automatically add items to your online grocery cart at supported supermarkets (e.g. Coles, Woolworths). This feature operates by interacting with the supermarket's website on your behalf.
We are not affiliated with, endorsed by, or partnered with any supermarket. Prices, product availability, and product substitutions are determined entirely by the supermarket and may change without notice. We do not guarantee that all items will be found, that prices will match expectations, or that substitutions will be appropriate for your needs.
You are responsible for reviewing your cart before completing any purchase. Cartd is not responsible for any purchases made through supermarket websites.
8. Limitation of Liability
To the maximum extent permitted by law, Cartd and its directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to your use of the Service, including but not limited to:
Adverse health effects, allergic reactions, or illness resulting from meals prepared using AI-generated plans or recipes; financial loss from grocery purchases; loss of data; or interruption of the Service.
Nothing in these Terms excludes or limits liability that cannot be excluded or limited under Australian Consumer Law, including consumer guarantees under the Competition and Consumer Act 2010 (Cth).
Where our liability cannot be excluded, our total aggregate liability to you for all claims arising from or related to the Service is limited to the amount you have paid us in the 12 months preceding the claim, or AUD $100, whichever is greater.
9. Indemnification
You agree to indemnify and hold harmless Cartd and its directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the Service, your violation of these Terms, or your violation of any third-party rights.
10. Data and Privacy
Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal information. By using the Service, you consent to the practices described in the Privacy Policy.
11. Service Availability
We aim to keep the Service available at all times but do not guarantee uninterrupted access. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control. We will make reasonable efforts to provide advance notice of planned downtime.
We reserve the right to modify, suspend, or discontinue any part of the Service at any time. If we discontinue the Service entirely, we will provide reasonable notice and, for paid subscribers, issue a prorated refund for any unused portion of their subscription.
12. Modifications to These Terms
We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on this page and updating the "Last updated" date. Your continued use of the Service after changes are posted constitutes your acceptance of the revised Terms.
If you do not agree with any changes, you may stop using the Service and close your account.
13. Governing Law
These Terms are governed by and construed in accordance with the laws of Australia. Any disputes arising from these Terms or your use of the Service shall be subject to the exclusive jurisdiction of the courts of Australia.
